The Supreme Court has dismissed the immunity claim of Yankuba Touray over the death of former finance minister Ousman Koro Ceesay in 1995.

Mr Touray, 54, is currently facing murder  trial at the High Court in Banjul over the death of Koro Ceesay. He was arrested and charged after he refused to testify before the Truth, Reconciliation and Reparations Commission claiming that he had constitutional immunity as a former member of the AFPRC junta. 

In a landmark ruling on Monday, the nation’s apex court explained in a 38-page judgment why it dismissed Mr Touray’s claim, and said the death of Ousman Koro Ceesay “could by no stretch of the imagination be said to have been carried out during the course of his official duties”.
