High court judge Momodou SM Jallow will rule on Bob Keita’s DNA paternity test order on Wednesday (July 27).
The order instructed Bob Keita and Pa Modou Johm, the accuser’s boyfriend, to undergo DNA paternity test to determine the biological father of the child at the centre of the rape case.
Keita is accused of raping his ex-wife’s underaged sister leading to pregnancy.
He denied the charge.
Keita’s defence lawyer Lamin S Camara today (25 July) filed a motion to seek the court to set aside its order for a DNA paternity test made on July 7, arguing that the state had failed to conduct a DNA test before prosecuting the case.
Camara also filed an affidavit to support his submission.
He told the court that his application has merit and enjoined the court to grant his request
He added that the submission will expedite the case that has dragged on for three years.
However, the state prosecutor Patrick Gomez argued that the defence lawyer has not given any tangible reason as to why the court’s order for a DNA test should be set aside.
Gomez further argued that the process of stay of execution in a criminal trial is “unknown to law”.
