Kanimang Bajo, the Chief Executive Officer of Ejabah Travel and Tours, is expected to appear before the Banjul Magistrates’ Court on Monday at 10am, following the withdrawal of his case from the Kanifing Magistrates’ Court on jurisdictional grounds.
The case was previously before the Kanifing Magistrates’ Court, where the prosecution informed the court that the alleged transactions connected to the case took place in Banjul.
The prosecution subsequently withdrew the matter and indicated that it would pursue the case before the Banjul Magistrates’ Court.
The latest development is expected to see the prosecution begin its case before the Banjul court, with information indicating that prosecutors have now put their case in order and are prepared to call their first witness.
The prosecution had previously faced delays in proceeding with the matter. During an earlier sitting at the Kanifing Magistrates’ Court, defence counsel complained that the prosecution had repeatedly failed to proceed, while the prosecution said it had a large number of witnesses and was still consulting complainants.
At that stage, the prosecution said it intended to call its first witness but the witness did not appear in court, leading to another adjournment. The court subsequently gave the prosecution another opportunity to proceed, stressing the accused’s right to a speedy trial.
The case was eventually withdrawn from Kanifing after prosecutors said the appropriate jurisdiction was Banjul.
Commissioner of Prosecutions Abdoulie Sanneh reportedly told alleged victims that the prosecution had established that Bajo’s office was located in Banjul and that payments connected to the allegations were made there.
