Momodou Sabally’s defence counsel Abdoulie Fatty has objected to an alleged defamatory audio against his client in the high court in Banjul.
Abubacarr Jawara, owner of Gach Global company, is demanding D8 million damages and public apology from Mr Sabally to be published in a widely circulated local newspapers as he accused the latter of defamation.
But lawyer Abdoulie Fatty cited section 22, 23, and 25 of the Evidence Act to object to the audio.
He has also filed a 43-paragraph documents in objection a defamation suit.
However, the plaintiff’s lawyer Ida Drammeh informed the court that they have filed 8 documents including four WhatsApp audios, Facebook and a warning letter as well as transcriptions of the audios in English as evidence.
The court accepted the warning letter with no objection from the defence counsel and marked it as exhibit PF(1) and the transcriptions of the audios as exhibit PF(2), but rejected the audio in a flash drive, citing it needs to be accompanied by a certificate under the Evidence Act section 22.
The defamation trial continues.
