Sainabou Mbye, Cherno Mbye and Kimbly Dambelly manslaughter case has been been postponed to Tuesday for a bail application hearing.
As the case was called up today, deputy defence counsel Sagar Jaiteh argued that Sainabou Mbye and the two men should not be addressed as accused persons because the state is yet to present any evidence against them in court.
However, state prosecutor Patrick Gomez objected to the defence counsel argument citing section 208 of the Criminal Code of the laws of The Gambia.
He said the magnitude of the case suits the subjects to be addressed as accused persons after their case was tranferred from a magistrate’s court to a high court.
Meanwhile, the defence counsel applied for a bail for the accused persons but the state prosecutors asked the court to give them time to prepare themselves for the bail application.
